Terms and Conditions

These Terms and Conditions govern the use of the Madeira Tuk Tuk website and the booking and provision of Tuk Tuk tours, experiences and private events operated by Veloz & Ardente – Lda, trading as Madeira Tuk Tuk.

By making a booking through our website, you acknowledge that you have read and accepted these Terms and Conditions.

2. Our Services

Madeira Tuk Tuk provides Tuk Tuk tours and experiences in Funchal and other areas of Madeira, as well as private tours and services for events such as weddings, birthdays, corporate events and private celebrations.

Tours may vary in duration, route, destinations and availability. The specific details applicable to each booking will be those presented on the website at the time of booking.

We reserve the right to adapt or modify a route when necessary due to traffic, road conditions, road closures, construction, weather, safety considerations or other circumstances beyond our reasonable control.

3. Bookings

In these Terms and Conditions, our bookings can be made through our website using the online booking system.

A booking is considered confirmed once the booking process has been completed and full payment has been successfully received.

Customers are responsible for providing accurate information when making a booking, including the date, time, number of passengers and any relevant special requirements.

If you have specific requirements, including luggage, reduced mobility or other circumstances that may affect the tour, please contact us before booking or as soon as possible after making your reservation.

4. Prices and Payment

All prices displayed on our website include applicable taxes and VAT unless otherwise stated.

Full payment is required at the time of booking.

Payments are processed through the payment methods made available during the checkout process.

Once payment has been successfully completed, a booking confirmation will be sent to the email address provided by the customer.

5. Tour Duration and Timing

Customers are expected to arrive at the agreed meeting point on time.

Late arrival may reduce the available duration of the tour and, depending on the circumstances and the amount of time lost, may result in the tour being treated as a no-show.

We recommend arriving at the meeting point a few minutes before the scheduled departure time.

The tour duration refers to the scheduled duration of the experience and may be affected by traffic, road conditions, safety requirements or other circumstances beyond our control.

6. Tuk Tuk Capacity

Each Tuk Tuk can accommodate a maximum of 3 passengers.

For safety and comfort, the combined weight of passengers seated in the rear area must not exceed 210 kg / 460 lbs.

For larger groups, multiple Tuk Tuks may be arranged subject to availability.

7. Children

Children aged 3 years and over are welcome on our Tuk Tuk tours.

Children must remain seated and use the seatbelt throughout the journey.

Children aged 3–9 years travel free, with a maximum of 1 child per 2 paying adults, for a maximum of 3 passengers per Tuk Tuk.

Customers must inform us in advance when travelling with children so that we can make the appropriate arrangements.

Additional children may require a second Tuk Tuk and may be subject to additional charges.

8. Luggage

Tuk Tuks have limited storage space, particularly in the rear passenger area.

Customers travelling with luggage must inform us in advance and provide details of the amount and size of the luggage.

We cannot guarantee that large suitcases or excessive luggage can be accommodated.

For safety reasons, luggage must be securely stored and must not obstruct passengers, the driver or the operation of the Tuk Tuk.

9. Accessibility and Mobility Equipment

Customers travelling with walkers or wheelchairs should inform us in advance.

Due to the limited space available in the Tuk Tuk, we will assess each situation individually and determine the safest and most suitable way to accommodate and/or transport the mobility equipment.

We cannot guarantee that every type or size of wheelchair or mobility equipment can be accommodated.

10. Safety and Passenger Responsibilities

Passengers must follow the instructions of the driver at all times.

Seatbelts must be used whenever provided.

Passengers must remain seated during the journey and must not interfere with the driver or the operation of the Tuk Tuk.

Customers must not place themselves, other passengers or the driver at risk through unsafe, aggressive or inappropriate behaviour.

The driver may refuse or terminate a tour if a passenger’s behaviour creates a safety risk or seriously affects the experience of other passengers.

11. Alcohol and Inappropriate Behaviour

Passengers must not board or remain on a Tuk Tuk while excessively intoxicated or under the influence of substances in a way that may compromise their own safety, the safety of others or the operation of the vehicle.

The driver may refuse transportation or terminate a tour if a passenger behaves aggressively, abusively, dangerously or inappropriately.

In such circumstances, no refund will normally be provided, without prejudice to any rights that cannot legally be excluded.

12. Weather Conditions

Our Tuk Tuks are equipped with waterproof windows to provide protection in rainy weather.

Tours may continue in normal or manageable weather conditions.

If weather conditions become severe or unsafe, Madeira Tuk Tuk may modify, postpone or cancel the tour for safety reasons.

Where we cancel a tour due to severe weather conditions, customers will be offered, where reasonably possible, the option to:

  • reschedule the tour;
  • choose an alternative available tour; or
  • receive a full refund.

The final decision regarding whether a tour can safely operate rests with Madeira Tuk Tuk.

13. Changes to Routes and Experiences

We make every reasonable effort to operate tours according to the description presented at the time of booking.

However, routes, stops and destinations may need to be changed due to traffic, road closures, construction, weather conditions, safety considerations, local restrictions or other circumstances outside our control.

Such changes do not automatically entitle the customer to a refund where the tour can reasonably continue and the overall experience can be provided.

14. Cancellation by the Customer

These Terms and Conditions state that customers may cancel their booking.

Cancellations made at least 48 hours before the scheduled tour start time are eligible for a full refund.

Cancellations made less than 48 hours before the scheduled tour are generally non-refundable.

Any cancellation request should be made by contacting us through info@madeira-tuktuk.pt.

The cancellation time will be determined based on the date and time the cancellation request is received.

These cancellation conditions do not affect any mandatory consumer rights that may apply under Portuguese or European law.

15. Changes to a Booking

Requests to change the date or time of an existing booking should be made at least 48 hours before the scheduled tour.

Changes are subject to availability and are not guaranteed.

Where a requested change cannot be accommodated, the original booking and applicable cancellation conditions will remain in effect.

16. No-Shows

If a customer does not arrive for the scheduled tour and has not contacted us in advance, the booking will be treated as a no-show.

No-shows are non-refundable.

This also applies where a customer arrives so late that the tour can no longer reasonably operate.

17. Private Tours and Events

Madeira Tuk Tuk also provides Tuk Tuk services for private events, including weddings, birthdays, corporate gatherings and other celebrations.

Event services may include guest transportation, venue transfers, custom routes and other arrangements agreed with the customer.

Specific terms, prices, schedules and cancellation conditions may apply to private events and will be communicated to the customer before confirmation.

Where an event requires a customised service or proposal, the booking is considered confirmed once the agreed terms have been accepted and the required payment has been received.

18. Insurance

Madeira Tuk Tuk operates under a valid tourist entertainment registration (RNAAT 643/2021) and maintains the insurance required for its activity, including civil liability and personal accident insurance.

Insurance coverage is subject to the applicable policy terms, conditions, exclusions and limits.

19. Photography and Personal Belongings

Customers are welcome to take photographs and videos during their Tuk Tuk experience, provided that doing so does not compromise their safety or interfere with the driver.

Customers are responsible for their own personal belongings during the tour.

Madeira Tuk Tuk is not responsible for the loss, theft or damage of personal belongings left unattended or improperly stored, except where liability cannot legally be excluded.

20. Customer Responsibilities

Customers are responsible for:

  • providing accurate booking information;
  • arriving at the meeting point on time;
  • following the driver’s safety instructions;
  • using seatbelts where provided;
  • informing us in advance about children, luggage, mobility equipment or other special requirements;
  • behaving respectfully towards the driver, other passengers and members of the public.

Failure to comply with these responsibilities may affect the ability to provide the service safely.

21. Liability

Madeira Tuk Tuk will take reasonable measures to provide its services safely and professionally.

However, we cannot be held responsible for delays, route changes or interruptions caused by circumstances outside our reasonable control, including traffic, road closures, weather conditions, public events, accidents, strikes, government restrictions or other unforeseen circumstances.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

We will make reasonable efforts to investigate and resolve complaints directly with the customer.

Customers are also entitled to use the applicable consumer dispute resolution mechanisms under Portuguese law.

23. Consumer Dispute Resolution

In the event of a consumer dispute that cannot be resolved directly with Madeira Tuk Tuk, consumers may use the applicable alternative dispute resolution mechanisms.

The Centro de Arbitragem de Conflitos de Consumo da Região Autónoma da Madeira (CACC-RAM) is the regional public alternative dispute resolution entity for consumer disputes within its jurisdiction.

24. Privacy and Personal Data

The processing of personal data submitted through our website and booking system is governed by our Privacy Policy.

By making a booking, customers acknowledge that their personal data may be processed as necessary to manage the booking, provide the contracted services, process payments, communicate with the customer and comply with applicable legal obligations.

25. Website Use

The content of the Madeira Tuk Tuk website, including text, photographs, graphics, logos and other materials, is intended for general information and promotional purposes.

We make reasonable efforts to ensure that information published on the website is accurate and up to date. However, occasional errors, omissions or changes may occur.

We reserve the right to update, modify or discontinue website content, tours or services without prior notice, subject to any existing contractual obligations.

26. Third-Party Services

Our website may use third-party services, including payment providers, booking systems, hosting providers and other technology services necessary to operate our website and process bookings.

The use of such services may be subject to the respective third party’s terms and privacy policies.

27. Applicable Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of Portugal.

Nothing in these Terms and Conditions affects any mandatory rights or protections granted to consumers under applicable Portuguese or European Union law.

Where a dispute cannot be resolved amicably, the competent courts shall be determined in accordance with applicable law, without prejudice to the consumer’s mandatory rights regarding jurisdiction.

28. Changes to Terms and Conditions

Madeira Tuk Tuk reserves the right to update or amend these Terms and Conditions when necessary, including to reflect changes to our services, booking procedures or applicable legislation.

The version applicable to a booking will be the version in force at the time the booking is made, unless otherwise required by law.
